TERMS OF SALE

This page details the legal terms and conditions (henceforth referred to as "T&Cs") on which Big Style Fashions Inc (henceforth referred to as "BigDude") sell any items on BIGDUDECLOTHING.COM (henceforth referred to as "the Site") to the end customer (henceforth referred to as "You"). Please note these T&Cs only apply to the purchase of items on the site. Please ensure to read these T&Cs carefully and make sure that you understand them before ordering any items from the site. By placing an order, you confirm your acceptance of these T&Cs. You should print a copy of these T&Cs or save them to your computer for future reference. Every time you wish to order items, please check these T&Cs to ensure you understand the T&Cs which will apply at that time. BigDude reserve the right to amend these T&Cs from time to time.

A contract is formed between you and BigDude through:

  • The sites shopping pages which will lead you through the steps needed to place an order with BigDude. The sites order process allows you to check and amend any errors before entering checkout;
  • Please take the time to check the details of your order at each stage of the order process and before clicking “Complete Order”, as you will not be able to make any changes to your order after this point;
  • After placing an order, you will receive an email from BigDude acknowledging that BigDude have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to BigDude to buy a product. All orders are subject to availability and acceptance by BigDude.
  • BigDude will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched. The contract between BigDude will only be formed when BigDude send you the despatch confirmation.

Please note that Items are subject to availability. As there is a delay between the time when the order is placed and the time when the order is processed, the stock availability relating to particular items may change. If an Item becomes out of stock, BigDude will notify you as soon as possible and you will be refunded where BigDude have already taken payment. BigDude reserve the right to refuse an order, for example if the Item you have ordered is unavailable or out of stock. If BigDude are unable to obtain authorisation of payment. If there is an error in the product information including price or promotion on the site or if BigDude suspect fraudulent activity. If BigDude are unable to supply you with an Item in these circumstances, BigDude will inform you of this by email. If you have already paid for the Items, BigDude will refund you the full amount including any shipping costs charged as soon as possible.

ITEMS ON THE SITE

Images of the Items on the site are for illustrative purposes only. Although BigDude have made every effort to display the colours accurately, BigDude cannot guarantee that your computer's display of the colours accurately reflects the colour of the Items. Your Items may vary slightly from those images. All sizes and measurements of Items are approximate; however, BigDude do make every effort to ensure they are as accurate as possible. BigDude take all reasonable care to ensure that all details, descriptions and prices of Items are as accurate as possible on the site. BigDude reserve the right to refuse orders where information about Items has been mis-published, including without limitation prices and promotions. All our Items are sold on the basis that they are suitable for domestic use only. Please contact BigDude for further information if you intend using any Items in a business or public environment. BigDude take all reasonable care to ensure that the prices of Items are correct at the time when the relevant information is entered onto the site. Prices for Items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched.

Please note that whilst BigDude take utmost care in ensuring the content on the site (including descriptions of the Items and associated services such as shipping, payment terms, offers and promotions and shipping timescales) are accurate the site may at times contain typographical errors or other errors or inaccuracies and may not be complete or current. BigDude therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice on the site. Where this affects an order that you have already placed BigDude will notify you of the error if it will impact upon your order. In this regard, BigDude reserve the right not to fulfil any orders that you have placed based on information on the site that may contain errors or inaccuracies.

SHIPPING

You will be given various options for shipping of items during the order process. The options available to you will vary depending on where you are ordering from. Shipping charges will be applied in addition to the prices for the items you are purchasing. The amount of the shipping charge will depend on the shipping option you have chosen. Please note that in addition to the items and shipping charges BigDude apply to your order, you may also be required by your country of residence to pay import duties and taxes. Please contact your local customs office for further information so that you are aware of the applicable duties and taxes before you place your order. BigDude are not responsible for payment of such duties and taxes and in the event that you refuse to pay such duties and taxes and the order is returned to BigDude, BigDude will require you to pay any costs that BigDude have incurred as a consequence. You must provide BigDude with complete and accurate shipping address information. For the avoidance of doubt, this includes not only the address that your order is going to but also the name of the recipient. BigDude cannot be liable for any delays to your shipping or shipping of your order to the wrong address or the wrong person as a result of you supplying BigDude with incomplete or inaccurate information.
In the event no one is available at your address at the time of shipping, the package may be left in a safe location, or a card will be left by the courier giving instructions for rearranging shipping or collecting the items from a local depot. Signatures may not be required for shipping, Ownership and responsibility for goods pass to you upon shipping, either directly or by leaving it in a safe place or with another person.

You accept that BigDude are not liable for shipping to PO Boxes, apartments, care homes, hospitals, hotels or addresses where the package will be handed to a central location / reception staff or left in a post room. You accept that BigDude are not liable for delayed or missing deliveries, though replacements are provided if missing due to third-party fault after investigation, which can include a signed declaration of non-receipt. If a carrier investigation is required and you fail to provide a completed signed declaration of non-receipt within 5 working days of receiving it BigDude will be unable to progress with a carrier investigation. You would then forfeit your right to a refund.
Certain postal services require a minimum length of time before a missing investigation can be opened. Due to this time limitation, we may need to wait for this period to elapse before we're able to raise an investigation into a missing parcel. Any parcel that's subject to this time restraint will be raised with the postal service provider as soon as we are able without further action after initial contact has been made by you to BigDude.

BigDude will make every effort to deliver your order within estimated timescales. However, delays are occasionally inevitable due to unforeseen factors or events outside our control for example, material shortages, travel or transportation disruption, import delays, software or technical failures or higher than anticipated demand. Please note shipping of your order may take longer during sale or other busy periods. BigDude are unable to deliver on public and bank holidays, Christmas Day or New Year’s Day. On these dates, shipping will take longer than usual. Please allow an extra business day (i.e. Monday-Friday, excluding Saturdays, Sundays and public holidays) for each of these days when calculating the estimated shipping date and when choosing your shipping option.

RETURNS

BigDude have extended the returns window to 90 days from receipt of the products as described below. This means that during the relevant period if you change your mind or decide for whatever reason that you do not want to receive or keep the products, you can notify BigDude of your decision to cancel the order and receive a refund. Underwear is excluded from the 90 days return policy if they have been worn or the seal is broken, this is due to hygiene reasons
Products returned to BigDude within this period that are not faulty must be in a resalable condition with the tags intact and attached to the product. Any alterations void the warranty and render the goods non-returnable. For return instructions please see instructions on our returns page. You may be required to list individual product information when generating a return label. If this is not completed correctly there may be a delay in BigDude processing your refund until your return package arrives back at our warehouse. Our return instructions must be followed and our free return portal used. BigDude are not responsible for packages that are returned not using our free returns portal.

To cancel an order with BigDude, you need to let BigDude know that you have decided to cancel. Please let BigDude know by completing the online form on our contact page. If you cancel your order with BigDude and the package has not already been dispatched BigDude will make any refunds due to you as soon as possible by the method used to pay for the products. BigDude aim to refund any returns within 10 working days of the parcel arriving back at our warehouse. This time may vary during busy periods.

If your order has been dispatched to you before you decide to cancel your order please follow our normal return instructions which can be found on our returns page.
Please retain any proof of shipping from the post office.

For faulty products, BigDude will examine them or BigDude may have to return them to the manufacturer for examination. If the product is deemed to be damaged due to misuse or negligence on the part of You the customer, BigDude reserve the right to return the product to you and refuse a refund. Where applicable a refund will be provided to you within 10 working days of the day that BigDude receive the goods into our warehouse. BigDude do not offer an extended warranty outside of our standard 90 day return window.

TERMS OF USE

These terms set out how you may use the site and the content within them, whether as a guest or a registered user. Use includes without limitation accessing, browsing, or registering to use the site or submitting any contributions (defined below). These terms also set out how you may interact with BigDude on our official social media accounts (including without limitation our accounts on Facebook, X, Instagram, TikTok and Youtube). Interacting in this context includes without limitation: joining our official Bigdude group/page, following BigDude, “liking”, “retweeting”, or writing a comment in relation to a page, or submitting a contribution (defined below) on social media. All of BigDude’s social media shall together be referred to as the “services” in these terms.

Please also read our terms of sale, which relate to your purchase of items from the site, the privacy policy and accessibility policy that relate to information collected during your use of the site and other BigDude services. Please read the terms carefully before you start to use the services. By using the site and interacting with BigDude on social media, you are agreeing to these terms, the privacy policy, accessibility policy and terms of sale (collectively “our terms”) and agree to comply with them. If you do not agree to our terms you must not use the services. You are also responsible for ensuring that all persons who access the services through your internet connection are aware of our T&Cs and that all persons who access the services through your internet connection comply with them.
